CHRISTOPHER WESTFALL, KEVIN YEARGIN Info: Dottie Honer ------------------------------------------------------ NATIONAL TRANSPORTATION SAFETY BOARD Public Meeting of January 26, 1999 Aircraft Accident involving John Denver In Flight Collision with Terrain/Water October 12, 1997 Pacific Ocean near Pacific Grove, CA LAX-98-FA008 EXECUTIVE SUMMARY On October 12, 1997, about 1728 Pacific daylight time, an experimental category, amateur-built Adrian Davis Long-EZ airplane, N555JD, crashed into the Pacific Ocean near Pacific Grove, California. Air traffic control communications indicated that the airplane had departed from the Monterey Peninsula Airport's runway 28L about 1712, and the pilot performed three touch-and-go landings and departed to the west moments before the accident. Witness reported that they heard engine popping and a reduction in engine noise before the accident. The pilot made no distress calls. The pilot was killed, and the airplane was destroyed. PROBABLE CAUSE The National Transportation Safety Board determines the probable cause of this accident was the pilot's diversion of attention from the operation of the airplane and his inadvertent application of right rudder that resulted in the loss of airplane control while attempting to manipulate the fuel selector handle. Also, the Board determines that the pilot's inadequate preflight planning and preparations, specifically his failure to refuel the airplane, was causal. The Board determines that the builder's decision to locate the unmarked fuel selector handle in a hard-to-access position, unmarked fuel quantity sight gauges, inadequate transition training by the pilot, and his lack of total experience in this type of airplane were factors in this accident. SAFETY RECOMMENDATIONS As a result of its investigation of this accident, the NTSB makes safety recommendations as follows: to the Federal Aviation Administration: 1. Amend FAA Order 8130.2C to specify that, before the issuance of special airworthiness certificates, experimental, amateur-built airplanes should be inspected for needed placards and markings on cockpit instruments and for the appropriate placement and operation of essential system controls to ensure that they provide clear marking, easy access, and ease of operation. 2. Amend FAA Order 8130.2C to specify that inspection limitations be issued with special airworthiness certificates for amateur-built airplanes requiring that the annual condition inspection include an inspection for needed placards and markings on cockpit instruments and the appropriate operation of essential controls to ensure that they provide clear marking, easy access, and ease of operation. 3. Establish, in conjunction with the FAA and the Aviation Insurance Association, a cooperative program that strongly encourages pilots transitioning to unusual or unfamiliar experimental amateur-built category airplanes to undergo formalized, type-specific transition training similar to that provided to pilots of some advanced, experimental, amateur-built airplanes. * * * Lawyer for John Denver's family wants change in crash report By THE ASSOCIATED PRESS A lawyer representing John Denver's mother and three children wants the National Transportation Safety Board to reconsider its conclusion that pilot error contributed to the plane crash that took the singer's life. ''They sort of missed a key point here, and it makes the conclusion wrong,'' Los Angeles lawyer Bill Wimsatt said. ''I think it's critical for people to understand that John had very little to do with causing this accident considering he was following the rules.'' Denver was killed Oct. 12, 1997, off the coast of Pacific Grove, Calif., when the home-built Long E-Z aircraft he was flying ran out of fuel and fell into the ocean. The NTSB investigation concluded Denver took off with too little fuel in one tank, had trouble switching to his backup tank and inadvertently put his plane into a roll while his attention was diverted. Wimsatt, a licensed pilot, said Denver was carrying the maximum amount of fuel regulations allowed for the short flight he planned.'' He could be cited if he hadn't followed the rule,'' Wimsatt said. ''In following the rule, John basically got into a situation where the valve killed him.'' The plans for Denver's homemade plane say the fuel selector handle, which switches the fuel flow between the left and right tanks, should be located between the pilot's legs. The plane's builder, Texas aircraft maker Adrian Davis Jr., told investigators he put the handle behind the pilot's left shoulder because he did not want fuel in the cockpit. Wimsatt said witnesses reported hearing a sputtering sound just before the crash, indicating the engine had run out of fuel and stopped. That would mean the valve switch likely seized and Denver wasn't able to switch to the second tank.''We know it was working before he took off because it had to be switched before he started the engine,'' he said. ''Why it would pick that particular time to seize we don't know.'' Denver's family has filed a lawsuit charging the valve's manufacturer, Imperial Valve Co., and its parts supplier, Aircraft Spruce and Specialty Co., with making a faulty valve.'' "This valve should have been taken off the market and out of airplanes a long time ago,'' Wimsatt said. ------------------------------------------------------ Denver Post 1/27/99 John Denver crash report called flawed By Peggy Lowe Denver Post Staff Writer An attorney for John Denver's family on Tuesday criticized the final federal report on the plane crash that killed the pop singer and said he will ask the government to reconsider its conclusion. In a report issued Tuesday, the NTSB said the crash can be blamed on the plane's design as well as pilot error. Denver, the report said, took off with too little fuel in one tank, had trouble switching to a backup fuel tank and then inadvertently put the plane into a roll. But Bill Wimsatt, a Los Angeles lawyer who represents Denver's mother and the singer's three children, said the NTSB report is flawed. The report missed two vital issues, Wimsatt said. First, Denver could not have added fuel to the airplane because of federal weight limitations, and to fly with any more fuel would have been illegal, Wimsatt said. "Frankly it's such a basic mistake (by the NTSB), I don't see how they could have missed it, but they did. Big time.'' Second, Wimsatt said the NTSB's report incorrectly theorized that Denver caused the plane to roll while trying to reach the fuel selector valve. Instead, he said, Denver probably lost control of the plane because it became unbalanced after losing power."Their idea that he (rolled the plane by mistake) is not bad, but it's not a necessary ingredient to explain the accident,'' Wimsatt said."The more likely explanation is that the loss of thrust from the propeller created a change in balance that contributed to the loss of control of the airplane.'' Denver, the 53-year-old part time Aspen resident, was killed when his small, experimental plane plunged into the ocean off Pacific Grove, Calif., on Oct. 12, 1997. Witnesses said they heard a sputter, and federal investigators theorize that Denver ran out of fuel in the left tank and had trouble switching to his right tank. The plans for Denver's homemade Long E-Z say the fuel selector handle, which switches the fuel flow between the left and right tanks, should be located between the pilot's legs. The day of the crash, Denver and a maintenance technician talked about the handle's inaccessibility. "They tried a pair of Vise Grip pliers on the handle to extend the reach of the handle, but this did not work,'' said one investigative report. Under those circumstances, the pilot would have had to remove his shoulder harness, turn around and switch the handle. While doing so, Denver's right foot pressed against the right rudder, the report said, causing the aircraft to roll. The plane had no flight data or voice recorder, so investigators had to piece together their account of the plane's final minutes. "That's just a theory,'' Wimsatt said. "You don't need to theorize in that way to explain the accident.''But Wimsatt said he was glad the NTSB report highlighted the fuel valve. The NTSB said contributing factors included the builder's decision to relocate the fuel tank selector handle and an absence of markings on the handle and fuel gauges, as well as Denver's lack of training in his new plane. Denver's survivors have filed a lawsuit in a California court against the valve manufacturer, Imperial Valve Co., and its supplier, Aircraft Spruce and Specialty Co. The suit seeks undetermined monetary damages, he said. Wimsatt represents Denver's mother, Erma Deutschendorf of Aurora, two adult children from his first marriage, Zachary and Anna Kate, and his daughter by his second wife, Jesse Belle. Experimental and amateur-built aircraft like the Long E-Z are not subject to all FAA rules. The safety board recommended that the FAA, the Experimental Aircraft Association and insurers cooperate to "strongly encourage'' pilots of new experimental planes to undergo formal training, not now required. But an EAA official said training is already required twice a year and that pilots of experimental planes should not be singled out. "I don't see how they can isolate that need to EAA pilots,'' said Gayle Hess, president of a San Diego EAA chapter in San Diego. The AP and The Washington Post contributed to this report. ----------------------------------------------------------- REVIEW of John Adams "The Wandering Soul" by Mar Hoppe Everybody recording a CD with John Denver songs these days must expect a lot of skepticism. Firstly, we have seen literally dozens of such releases in the past few months. Secondly, John set a very high standard with his own recordings, which all others will be compared with. Only a few withstand the comparison. Pete Huttlinger and Chris Nole succeeded with their instrumental album "Colors in Time", many others convinced critics only partly or simply failed. Jos van den Brom released The Wandering Soul under his stage name John Adams. It's an album, which will probably be listened to more critically than any other. Since he triumphantly won the Dutch "Soundmixshow"(a sing-alike show) 10 years ago, he is well known as the "Dutch John Denver" and made himself a name with his renditions of John Denver songs all around the world. I beg your pardon when I will refer to him as Jos (instead of John Adams) hereinafter, to distinguish more easily between him and John Denver. The song list unveils immediately what heavy demands Jos made on himself. Eagles & Horses, The Wings That Fly Us Home and It Amazes Me are songs no other singer has dared to sing so far. He completely left out the obligatory hits - the best known songs are probably Perhaps Love and Fly Away. Besides that, he has included two songs, which are not directly connected with John Denver. To come straight to the point: The result is - even when being sparing in praise and in spite of some points of criticism - gorgeous! Although I may be prepossessed, I can only recommend this album warmly to every serious collector of John Denver's music. It's an absolute must! Jos did not take it easy. Some arrangements are so close to the original that you automatically expect to hear John's voice after the intro. The worst part is: Sometimes you realize only after the third or fourth word that someone else is singing... Then you are torn when Jos' version is more or less away from the original: Do you want an even bigger similarity to John, or would you prefer more of his own style? But what is connected with his personal style? Does it mean that the singer tries frantically to get further away from a perfect original, thereby automatically anticipating a worse result? The only alternative would be to not record the song at all! This is not really convincing, in my opinion. There is still enough space left to work on one's own creativity. Let me tell you, Jos has fully utilized this space...All of you know that the title track is a song that John Denver has not recorded for a CD. Although he had already started singing it in concert here and there in 1992, performed it twice at Windstar Symposia and published its words in his autobiography, no studio version is known. It had been planned for the WILDlife Concert, but was withdrawn in the last minute. The only recording which has been published can be found on a commercial video from the 1995 Windstar Symposium, the sound quality of which is not very good, unfortunately. Furthermore John forgot a few of the words then, so this version really lacks of quality. As on the other hand this song is one of the most meaningful Denver compositions ever, it was just a question of time that someone would take over responsibility and provide Wandering Soul with an adequate outfit. No doubt about it, Jos succeeded. It is not difficult to imagine what it would have sounded like if John had recorded the song properly himself. Jos is very, very close, although one or the other vocal part could have been more convincing. This song alone is one good reason to obtain the CD. There is a group of songs that is compiled of songs, which are among many fans' favorites, especially when sung in concert: Boy from the Country, Eagles & Horses, Darcy Farrow, Whispering Jesse, and Wild Montana Skies. All songs are played perfectly and the singing is also (almost) perfect. At times you hear the Dutch accent, which can be very charming, though. On Eagles & Horses Jos unites the brilliant technique of the original recording from the album The Flower That Shattered The Stone with the driving tempo from the WILDlife Concert version. Grandiose! Boy from the Country, Wild Montana Skies and Darcy Farrow are scarily close to the original, and Whispering Jesse was always one of Jos' strongest performances, which may have to do with its history (Jos and John once sang it together on Dutch television). Unfortunately it has been overheard during the final check that the whistling is very close to being off-key. That's a pity! It might be surprising to many that Love Is Everywhere and It Amazes Me were selected for this album, because these songs were never a part of John's or Jos' standard repertoire. The arrangement for Love Is Everywhere is very tight and dazzles through its power, although Jos' singing is a little bit too staccato. This recording's winner is Gill Wales, whose close harmony vocals really evoke a great country feeling. It Amazes Me simply knocks you off your feet! I almost don't dare mentioning it, but apart from a few pronunciation insecurities, you can almost call John's only existing recording boring, compared to this one... My impressions regarding The Wings That Fly Us Home are very mixed. On one hand Jos has included a lot of his own elements, which should be very welcome, but at times you wish he had stuck closer to the original. The drums almost hammer the dramatic final into pieces, and gone is what I have always felt to be one of the finest parts of all John Denver songs. This had been underlined by the 1997 solo tour, when John sang it in concert and treated us to what I would like to call the ultimate version. To me the best interpretation will always be the one consisting only of guitar and vocals. Two songs are brand new. Goodbye My Friend was written by pianist Harry Swinkels, according to an annotation in the booklet "in recognition of the untimely loss of John Denver. He was an inspiration to many people." This song clearly shows that Jos is able to sing one of today's grand ballads, which are at the head of the charts quite frequently. The second new song is I Know You, which could easily become a (country) hit. It was written by bass player Ad Welten and female singer Ilse DeLange. The latter is a 21 years old former salesclerk and regarded by many as an upcoming superstar. Her debut solo album came out most recently and topped the Dutch album charts in the second week of its release! All in all I'm thrilled about the album. The concept is great and was carried out consequently, except for a few minor faults. The musicians are very professional. It's Jos first CD.
